The DVB ruling is free, binding, and takes three months - if you know how to apply. In this article we explain step by step how to request an advance tax ruling (Dienst Voorafgaande Beslissing) for your crypto gains.

🔍 What is a DVB ruling and why should you apply for one?

The Dienst Voorafgaande Beslissingen (DVB), the Ruling Commission (Office for Advance Tax Rulings), is an official service of FOD Financiën. You can request a binding legal opinion on how the tax authority will treat your situation - before you file your tax return.

For crypto this is crucial. The difference between the "good family man" standard (bonus pater familias, prudent private investor - 10%) and speculative (33%) can mean tens of thousands of euros. A ruling gives you 100% certainty.

When is a ruling relevant?

  • Portfolio above EUR 50.000: The financial impact justifies the investment in certainty
  • You are close to the 25% threshold: Unsure whether you fall under normal management (of private assets)?
  • Active DeFi participation: You stake, farm yields, provide liquidity - the DVB asked many questions about this in 2026

🆕 What changed in April 2026?

The DVB updated its official questionnaire in mid-April 2026. The main changes:

1. Financial assets replaces movable assets

Before: your movable assets included ALL loose goods (cars, art, jewellery, crypto, shares, savings accounts).

Now: only financial assets count (savings, shares, bonds, pension savings plan branch 21/23, crypto). Your car and art collection no longer count.

Impact: The 25% threshold becomes easier to reach. Someone who previously had 22% in crypto may now have 28% - with the same car and art collection.

2. New questions on staking and DeFi

Explicitly asked:

  • Do you stake your crypto? On which protocols? How passively?
  • Do you participate in DeFi (lending, liquidity pools, yield vaults)?
  • How often do you move funds between protocols?
  • Do you use wallet segregation (separate wallets for passive vs. trading)?

3. Hardware wallet question removed

Before: "Do you have a hardware wallet?" was seen as a positive criterion (indication of caution). This is now gone - traders use Ledgers just as much as buy-and-holders.

Step 1: Preparation - completing the DVB questionnaire

The official questionnaire is publicly available at ruling.be. It contains approximately 17 questions:

  • Employer, nationality, place of residence
  • Total financial assets (savings + investments + crypto)
  • Amount and type of crypto (BTC, ETH, alts, stablecoins)
  • Time of purchase and holding period
  • Transaction frequency (number of trades per year)
  • Use of leverage (margin, futures, loans)?
  • DeFi participation (staking, lending, yield farming)?
  • Use of trading bots or automated strategies?
  • Professional background / financial knowledge
  • Investment objective (long-term vs. speculation)

Tip: Answer honestly and in detail. Superficial answers lead to follow-up questions and slow down the procedure.

Step 2: Drafting the written application

You write a letter (Dutch, French, or German) to the DVB. Required elements:

Step 3: Gathering and submitting documents

The DVB requires thorough evidence. Checklist:

Portfolio & transactions:

  • Complete transaction history from all exchanges (Binance, Kraken, Bitvavo, Coinbase, ...) - export as CSV
  • On-chain transaction history (Etherscan/Arbiscan exports for wallets)
  • Wallet snapshots as at 31 December 2025 (screenshot + block explorer link) with EUR rates
  • Current portfolio value and composition

Proof of financial assets:

  • Statements from your savings account(s) - current balance
  • Statements from investment account(s) (shares, bonds, funds)
  • Extract from pension savings plan (branch 21/23) if applicable
  • Tax returns for the previous 3 years (copies)

Proof of holding period:

  • Screenshots of your portfolio at historical moments (e.g. every 1 October since purchase)
  • Emails from exchanges about purchases or deposits
  • Money transfers to exchanges (bank statements)

DeFi activities (if relevant):

  • Screenshots of your DeFi positions (Ethereum staking, Uniswap LPs, AAVE lending, Lido staking, ...)
  • Addresses of your DeFi interactions (contract addresses on block explorer)
  • Frequency of rebalancing (how often do you move money between protocols?)

Borrowed money (if relevant):

  • Proof that you did NOT purchase crypto with borrowed money (bank statements for each purchase, origin of funds)

Step 4: Submitting

You submit your application to the DVB. Two options:

  • Digitally via financien.belgium.be - modern method, upload your letters and scans
  • By post to: Dienst Voorafgaande Beslissingen, Kunstlaan 47-49, 1000 Brussels

You will receive a case number. Keep it - you will use it in all further correspondence.

Step 5: Hearing (optional)

The DVB may invite you to an oral hearing (by phone or in person). This is not mandatory but highly recommended:

  • You can clarify any ambiguities directly
  • The DVB officer gains additional insight into your situation and intentions
  • You can explain nuances that are less clear in writing

Step 6: Binding decision

On average 2-3 months later you receive an official decision from FOD Financiën. This contains:

  • Clear answer: are you a prudent private investor, speculative, or professional?
  • Basis: which facts/criteria were decisive?
  • Validity period: typically 5 years
  • Binding nature: for both you and the tax authority

You can use this document in your tax return or as a defence in a tax audit.
